Ok, I have been waiting for the members verdict on my life sentence of banishment at Nachos and Beer for 3 weeks now with nary a private message or reply to the now locked thread I started. Now I mentioned I'm all for being banned if indeed your rules are to kick and ban at whim. Judging by the list of appeals that have been posted here recently, even with a small community left in UT, I see the ban button can get addictive. For the record Filak613 mentioned if you guys were a company you could see my point. " Online play? Rated different. This is a private server owned and operated by a private party. If it were owned by a company I can see your justification." Well, I see you are selling merchandise right here in the forums. borforum.proboards107.com/index.cgi?board=rgstoreand also asking for donations under the paypall server fund on your home page. Now maybe you are not an LLC or what not, but you are a business and are hopefully licensed as such to do business over the internet. All I want is my verdict so that i know how to proceed. -NP running out of options

First, I would like to apologize for our delay in relaying our decision, which was to leave the ban in place temporarily. We do have lives outside of this community to deal with and it has apparently been busy for most of us this last month.
Second, I'd like to clarify some misunderstandings brought up in your post: A) The servers do not generate a profit nor is Reborn Gamers a For-Profit organization nor is it an official organization. Also, when using cafe press you do not need to be a licensed retailer as they are the retailer and are paid with fees from purchases made through their site.
B) The server fund is to recoup costs paid by the server owners who pay out of their pockets for the servers and if you'd take the time to look it's clearly posted in the donator section how much the server costs and how much is donated by community members each month. Clearly this is a profitable venture if we were a business, which we're not.
C) The rules are declared by the server owners and it is our jobs as admins to interpret those rules in the most fair manner.
We do not ban, kick, mute, etc. without reasonable cause. Many times the situation is put before multiple admins in our IRC server for confirmation before any action is taken to confirm a proposed punishment if any.
Finally, I'd like to discuss your specific case. The name was deemed inappropriate for our servers and action was taken. Upon further inspection we had discovered a much longer list of inappropriate names which is one of the reasons we had decided to leave the ban in place for the time being.
Also, your attitude and lack of respect towards the admins and policies of this community are also unappreciated. It clearly specifies to clearly post your case with any explanation without, and I am paraphrasing here, criticizing the admin, decision, or rules with personal opinion. Muffin also posted this information in you appeal thread. These factors contributed to our decision to leave the ban in place temporarily.
After having said all of this, I know it's a lot to absorb, I have decided to leave the ban in place for one month from this date.
Ban will be lifted 12/14/08.
